THE FOLLOWING DESCRIBES THE TERMS BY WHICH LUXE VACATION PROPERTIES OFFERS YOU ACCESS TO OUR SITE AND SERVICES.
This agreement (Agreement) is between (guest) and LUXE Vacation Properties LLC/Booking Agent on behalf of the owner (owner) in regards to (Premises). Guest shall use the Premises for residential purposes only. Guest shall have non-exclusive right of possession to the Premises during the term of this Agreement. The Premises are licensed under the 509 state laws and shall be used so as to comply with all state, county, municipal laws and ordinances, and all covenants and restrictions affecting the Premises and all Rules and Regulations of homeowner's associations and owner affecting the Premises.
An advance payment equal to 50% of the rental rate and fees is required upon execution of this Agreement. The balance of payment must be Paid no later than 60 days before arrival. The advance payment will be applied toward the property rent and fees. All payments must be made by credit card, Traveler’s checks, bank money order, cashier’s check, personal check, or bank wire transfer. All payments required herein must be received no later than 48 hours after this Agreement is executed or this Agreement will be deemed void. All payments other than via credit card or bank wire transfer must be Drawn on a bank domiciled in the United States.
Please contact the Property Manager upon arrival at the airport (800-385-6513 ext. 3). The Property Manager will give you Instructions on how to check in to your vacation rental. Check in time is between 4pm and 5pm. Early arrivals are not permitted without prior written permission.
Check out time is at 10:00AM and is strictly enforced. You will be charged a late departure fee in the event you do not depart on time (the amount will be dependent upon how the late departure affects the next renter). Please do not leave any food exposed. Lock all doors and windows, including sliding glass doors, turn off all lights, and set air conditioning to 80 degrees. Please return keys and/or gate passes to the designated location as instructed by the Property Manager. The Property manager reserves the right to charge your security deposit in the event excess cleaning is required or you fail to observe the foregoing procedures.
The Security Deposit is collected in addition to the rental fees. All security deposit monies shall be refunded promptly by mail no later than fifteen (15) days after departure, provided there is no damage; extraordinary cleaning or inventory unaccounted for. For rental periods of one month or longer, the security deposit will be refunded by mail no later than (30) days after departure. The Guest is required to pay for Damage Protection Insurance (in addition to the Security Deposit). In the event of extraordinary cleaning, damage to the property, or unaccounted for items, the first monies will go against the Security Deposit. Only if/when the Security Deposit is exhausted will the remaining claim be placed against the Damage Protection insurance.
In the event of a conflict in scheduling or if the property is sold prior to check-in, every attempt will be made to locate a comparable vacation rental property for the Guest. The Guest shall not be obligated to accept the new property and shall have the option to terminate this Agreement and receive a full refund. Rental homes are to be use for residential purposes only and subletting is prohibited. No alterations, installations or re-decorating are allowed. Pets are not allowed unless the property is Designated Pet Friendly and unless the pet was approved by the Property Manager in writing and in advance at the time the reservation was made. In the event an unapproved pet is brought to the rental property, occupancy will be refused and/or terminated and all monies will be forfeited. If a pet is approved, excessive noise and/or disturbances to neighbors may be grounds for immediate termination and/or forfeiture of monies. All guests agree to abide by association/city rules. NO DAYTIME/ NIGHTIME VISITORS ARE PERMITTED WITHOUT CONSENT OF THE PROPERTY MANAGER. Only the individuals that are listed at the time the reservation is made are permitted in the Property. Smoking is prohibited in the Property.
GARAGES, DOCKAGE AND BOAT LIFTS
The vacation rental does not include garages, dockage, and boat lifts unless specifically included in this Rental Agreement.
All utilities (electric and gas) will be provided for all short term rentals. For rental periods of one-month or longer, all utility charges will be deducted against the security deposit.
Only selective rental homes offer telephone service. The Guest shall be responsible for all long distance charges which must be made using Guest’s credit card or calling card.
The Guest will be responsible for placing garbage out for collection. The trash receptacles must be placed at the designated curb side on the night before the designated pick-up dates below or a charge of $250.00 will be deducted from the security deposit for trash disposal fees. All trash must be sealed in plastic garbage bags before being placed In the trash receptacles.
WHAT IS FURNISHED
The kitchens are fully equipped with all basic cooking supplies including dishware, eating and cooking utensils, and small and large appliances. In addition, linens (one set per bed) and bath towels (one set per person) are provided.
The Property is self-serve without housekeeping services. Luxe provides optional housekeeping services for an additional charge. If you would like housekeeping services during your stay, please call the Property Manager at 800-385-6513 ext. 3.
POOL AND SPA
Guests shall not touch any pool or spa controls without the prior consent of Property Manager. In the event a control is changed and Property Manager requires a technician to adjust same, $150.00 shall be deduced from the Security Deposit.
MAINTENANCE AND REPAIRS
Property Manager does not guarantee maintenance or repairs on all items. Please report all maintenance/repair issues immediately to Property Manager so that we can attempt to make the repairs as soon as possible (within 48 hours). Cable television, radio/stereo equipment, internet service, and telephone service are all complimentary services at no charge. Property Manager has no control if these items are not working and the failure of these items shall not result in any reduction in rent. Property Manager will do its best to fix the items as soon as possible.
All vehicles must be parked on the property. No vehicles are allowed to be parked on the street. Any vehicle not parked on the property may be towed at Guests expense. The property will allow a total of ____ vehicles
INSPECTION AND ACCEPTANCE OF PROPERTY
The Guest will inspect the Property upon arrival. The Property and all contents will be deemed in working order and accepted unless Guest notifies the Property Manager (800-385-6513 ext. 3) within two (2) hours of arrival.
CANCELLATIONS/NO REFUND POLICY
There are no cancellations or refunds and all sales are final. We encourage you to contact our agent at Luxe (800-385-6513 ext.4), if interested in purchasing travel insurance protection.
This is a NON SMOKING property. Smoking is strictly prohibited.
Any reservation obtained under false pretenses will be subject to forfeiture of advance payment and termination of this Rental Agreement.
In the event of a discrepancy between the information given at the time the reservation is made and the information given at the time of arrival, Property Manager may increase the rent and/or terminate this Rental Agreement, at Property Manager’s sole discretion.
Any exceptions to any of the rules and regulations set forth in this Rental Agreement must be approved by Property Manager in writing.
HURRICANE OR STORM POLICY
No refunds will be given for any reason. We highly recommend you purchase travel insurance. Go to Conceirge Service and click on Insurance for more details, if interested in purchasing travel insurance protection.
Guest is responsible for all of the individuals staying in the Property. Guest, for himself/herself and all others in the property hereby release and hold harmless Property Manager, and its officers, directors, agents, and employees, from any loss to person or property for any reason whatsoever.

JURISDICTION AND VENUE
These Terms shall be interpreted in accordance with the laws of the City and State of Fort Lauderdale, Florida and the United States of America, without regard to conflict-of-law principles. You and we agree to submit to the personal jurisdiction of a state court located in Fort Lauderdale,Florida. Any action brought against LVP shall be venued in Broward County, Fort Lauderdale, Florida.
The prevailing party in any action brought under this agreement shall be entitled to reasonable attorney's fees and costs.
The guest has 2 hours after check in to notify the property manager / agent regarding any issues, after 2 hours everything is deemed accepted. No further claims. only be accepted to the claims department. in the event if the claim is issued in the 2 hours. Luxe will contact the owner on behalf of the guest. And the guest will be contacted in 24 hours. The Property Manger / agent takes no responsibility regarding the issue. The Property Manager / Agent will assist the guest and the owner in mediating the issue.
